Załącznik nr 5 do Umowy

§ 3. Zgodnie z art. 786 § 1 Kodeksu postępowania cywilnego spółka pod firmą
Polskie Sieci Elektroenergetyczne Spółka Akcyjna z siedzibą w Konstancinie - Jeziornie
będzie uprawniona do wystąpienia o nadanie klauzuli wykonalności niniejszemu aktowi
notarialnemu pod warunkiem przedstawienia jej oświadczenia o odstąpieniu od Umowy z
podpisem urzędowo poświadczonym lub innego dokumentu urzędowego
potwierdzającego odstąpienie od Umowy.


Notariusz wyjaśnił Stawającemu treść i skutki prawne wynikające z art. 777 § 1
pkt 4) Kodeksu postępowania cywilnego oraz pouczył o treści art. 786 § 1 Kodeksu
postępowania cywilnego.



§ 3. Koszty sporządzenia aktu poniesie Wykonawca.

§ 4. Wypisy aktu mogą być wydawane także Zamawiającemu w dowolnej liczbie
egzemplarzy.

§ 5. Koszty związane z podpisaniem niniejszego aktu notarialnego wynoszą:

1) wynagrodzenie notariusza na podstawie § 2, § 3, § 5 i § 16 rozporządzenia Ministra
Sprawiedliwości z dnia 28 czerwca 2004 roku w sprawie maksymalnych stawek taksy
notarialnej (Dz. U. Nr 148, poz. 1564 ze zm.) - w kwocie ,00 zł,

2) należny od powyższego wynagrodzenia podatek od towarów i usług (23 %) na
podstawie art. 146a pkt 1) w związku z art. 41 ust. 1, art. 2 i art. 15 ustawy z dnia 11
marca 2004 roku o podatku od towarów i usług (Dz. U. Nr 54, poz. 535 ze zm.) - w
kwocie ,00 zł.
Akt ten został odczytany, przyjęty i podpisany.
